Terms and Conditions of the Website www.AlpsDrivers.com User Agreement
The following terms and conditions apply to passengers booking with AlpsDrivers.com.
- General Terms
1.1. By accessing, browsing and using AlpsDrivers.com, or any of the website′s applications through whatever platform and/or by completing a reservation, you acknowledge that you have read, understood, and agree to abide by the terms and conditions set out below.
1.2. These pages, the content and infrastructure of these pages, and the online transfer reservation service provided on these pages and through the website are owned, operated and provided by AlpsDrivers.com.
1.3. The Transfer Service Providers listed on www.AlpsDrivers.com, have entered into an agreement with the corporation AlpsDrivers.com, by ordering any services from www.AlpsDrivers.com you are entering into a contract with the Transfer Service Providers themselves, and not directly with AlpsDrivers.com.
- Booking and Payments
2.1. Where two or more people are included on the same booking, or a booking is being made on behalf of a third party, the person purchasing the booking (the Client) shall be deemed to be acting as an agent for all the members of the party travelling (the Passenger/s) and accepts the AlpsDrivers.com Terms and Conditions on behalf of each member of the party.
2.2. AlpsDrivers.com will endeavor to honor requests made in the Special Requests box, but is not obliged to do so. Further, AlpsDriver.com is entitled, on behalf of the Transfer Service Provider, to refuse any booking made. Every attempt will be made to allocate an appropriate Transfer Service Provider for the requested booking, however, AlpsDriver.com cannot guarantee that every request will be successfully matched. In the event that a Transfer Service Provider cannot be identified, the Client will be notified electronically.
2.3. It is the responsibility of the Client to provide a full and valid drop-off/ pick-up address within the destination/ departure town selected for the transfer route at the time of booking. If the address provided is incomplete, or does not correspond with the selected transfer route, the Passengers will be dropped off, or collected, at the central Tourist Office of the selected destination/ departure town.
2.4. It is the responsibility of the Client to provide a full and valid mobile phone number for the Passenger(s), including the International Dialing Code. It is the responsibility of the Passenger to check for messages left on this contact number during the final 24 hours prior to their return journey. Pick-up times can vary due to weather or high levels of traffic, etc. If it is not possible to supply a mobile contact number, it is the responsibility of the Client to provide a valid contact number. Any notification of changes to the pick-up times will be notified by SMS text, or by calling the contact number provided. If neither a mobile contact number nor an alternate resort contact number can be supplied, it is the responsibility of the Passenger(s) to contact their Transfer Service Provider on the number provided on their Transport Voucher to confirm their pick-up time. Failure to check for messages, or to contact your Transfer Service Provider if no contact has been supplied, may cause you to miss your resort pick-up, in which case no refund is available. If you have supplied a full and valid contact number, and have received no message, your pick-up will be as confirmed on your Transport Voucher.
2.5. AlpsDrivers.com will issue a Booking Receipt during the 48 hours since the booking is completed and required payment is submitted. A Booking Receipt is not a valid confirmation of a booking. If AlpsDrivers.com is able to provide the service, a confirmation email (Transport Voucher) will then be sent to the Client. If AlpsDrivers.com is unable to provide the service, a cancellation email will be sent to the Client. In case of cancellation, an alternative Transfer Service Provider may be offered, which may incur additional charges. In case of refunds due to cancelation of the booking by AlpsDrivers.com, all payments made for the booking will be refunded in the same currency used for payment.
2.6. The confirmation email (Transport Voucher) is the ticket. This must be presented to the Transfer Service Provider, or his representative, for both the outward and return trip.
2.7. By completing a booking on AlpsDrivers.com, the Client asserts that the details provided at the time of the booking, for the purpose of purchasing Transfer Services, are correct, and that the method of payment (credit or debit card) belonging to the Client, has the sufficient funds or credit facilities to meet the costs of the Service provided. AlpsDrivers.com reserves the right to obtain validation of your credit or debit card details, before confirming Services provided. If validation cannot be obtained, and payment is not submitted, AlpsDrivers.com reserves the right to cancel the booking and refuse service on behalf of the Transfer Service Providers.
2.8. The Client can change the reservation details by e-mail or by phone not less than 3 days prior to the date of outbound travel. All changes are subject to availability and may be subject to an administration charge. AlpsDrivers.com will endeavor to honor requests for modifications, but is not obliged to do so.
3.1. Passengers are limited to one item of luggage, such as a suitcase or similar item, per person. Customers travelling to ski resorts may also travel with one ski or snowboard bag per person. Any excess baggage must be declared at the time of booking. AlpsDrivers.com, and its Transfer Service Providers, reserves the right to charge a supplement for excess baggage, or to refuse to transport excess items.
3.2. It is the Passengers responsibility to inform the Transfer Service Provider in case of lost or delayed luggage. The lost or delayed luggage will be delivered to the passenger by the airline and/or handling agent of the airline, as it is their responsibility, and not the responsibility of the Transfer Service Provider.
3.3. The make, model and type of vehicle used for AlpsDrivers.com transfers may vary from those pictured on the AlpsDrivers.com website.
3.4. All AlpsDrivers.com vehicles are fully insured for passenger and third party claims, as required under local law. However, whilst every care is taken, the Passengers property is carried entirely at their own risk and AlpsDrivers.com, and its Transfer Service Provider’s, shall bear no responsibility for loss or damage. Passengers are advised to check their own travel insurance.
3.5. Passengers are not permitted to carry alcoholic beverages onto AlpsDrivers.com vehicles for the purposes of consuming them therein.
3.6. AlpsDrivers.com, and its Transfer Service Providers, reserves the right to refuse to transport any person who is thought to be under the influence of alcohol and/ or drugs and/ or whose behavior is consider to pose a threat to the driver, the vehicle and/ or other passengers or road users.
3.7. Smoking is not permitted in the vehicles.
3.8. It is the responsibility of the Client to reconfirm the booking, and the pickup times from the resort to the airport with the Transfer Service Provider the day before departure, but not less than 24 hours before departure from the resort. If the booking is not reconfirmed by the Client, the Transfer Service Provider cannot guarantee that the service will be provided, and the Transfer Service Provider will not be liable for any losses or additional costs incurred by the Passengers.
3.9. The transfers, and transfer times, organized by the Transfer Service Provider, are scheduled to arrive at the airport two hours before the scheduled departure time of a flight. It is the responsibility of the Client, and the Transfer Service Provider shall bear no responsibility and shall not be liable for any additional costs, if the Client schedules or insists of arranging a pickup time allowing for less time between leaving the resort and the scheduled departure time, resulting in missing of a flight or an onward connection.
3.10. If the Client is not at the specified pickup point at the previously arranged pickup time (excluding arrival flights), and the Transfer Service Provider has not been previously informed, the Transfer Service Provider is not obliged to wait for the Client.
3.11. If a transfer has been booked, and the Passenger(s) is subject to delay, the driver will wait for up to 90 minutes free of charge, after which the Passenger(s) will be deemed to have missed their transfer. In this circumstance no refund is available. Additional waiting time may be arranged by contacting your driver in advance on the number provided on your Transport Voucher, at a cost of € 20 per hour or part thereof, subject to availability. In case of delays, it is the responsibility of the Passenger(s) to contact the driver on the number provided on the Transport Voucher; this should be done as soon as the Passenger becomes aware of the delay.
3.12. For children under the age of 12, or measuring 1m35cm, the appropriate child seat must be used. It is the responsibility of the Client to request baby car seats and children’s booster seats at the time of booking. Children’s car seats and booster seats are supplied free of charge. The seat supplied by the Transfer Service Provider will be allocated to the Client based on the specified weight group for the child, at the time of travel, in their booking request. The supplied seat on the transfer will be Kitemarked to be suitable for a child of the specified weight. Children under the age of 12 are not permitted to travel in the front seats of any vehicle.
3.13. Children and adolescents under the age of 18 years, are the responsibility of the parents, or minders (or friends over 18 years of age), while in the Transfer Service Provider’s vehicle. This included responsibility for the conduct of these minors, as the parents or minders (or friends over 18 years of age) will be held responsible for any damage caused by the aforementioned minors.
3.14. Damages caused by the Passenger(s) to a Transfer Service Provider’s vehicle are to be paid for immediately. If payment cannot, or will not, be made, then the Transfer Service Provider will be forced to take legal action against the Passenger(s) in question.
3.15. An additional fine of 150.00 Euros will be applied to Passengers who soil or damage the interior, or exterior, of the transfer vehicle van due to alcohol or drug consumption. This fine is payable immediately to the Transfer Service Provider`s driver.
3.16. Any complaints or claims that arise during the provided transfer, should be voiced directly to the Transfer Service Provider during, or immediately, after the transfer.
4.1. Cancellations must be made by email, and will be confirmed by email. If no confirmation of cancellation has been received, it is the responsibility of the Client to contact AlpsDrivers.com – Contacts. Cancellations must be made more than 4 days in advance of the outbound date of travel. AlpsDrivers.com reserves absolute discretion in evaluating the specific circumstances regarding a cancellation, and to make a decision regarding partial refund, subject to a deduction of bank and administrative charges.
4.2.AlpsDrivers.com maintains the right to cancel bookings at any time if it feels it will be unable to supply the service requested in the appropriate manner.
- Liability of Transfer Service Provider
5.1. Transfer Service Provider will endeavor to carry the Passenger(s), with the maximum of comfort, to their destination at the time shown on their Transport Voucher. The Transfer Service Provider will not incur any liability whatsoever if circumstances beyond its control prevent the completion of the above mentioned goal. The following are examples of circumstances which are beyond the Transfer Service Providers control (this list is not exhaustive):
- Accidents causing delays to the vehicle.
- Restricted vehicular access.
- Exceptional or severe weather conditions.
- Compliance with requests of the police or government officials.
- Vandalism and/ or terrorism.
- Unforeseen traffic delays.
- Industrial action by third parties.
- Other circumstances beyond control.
5.2. If a Transfer Service Provider is unable to fulfill his functions, and transport the passenger(s) to a place and at time specified in the Transport Voucher due to emergency circumstances, then a similar vehicle or a vehicle of higher class will be offered. The difference will be refunded to the Client, if the vehicle available for the transfer is lower class than ordered in the original booking.
6.1. With the exception of disclosures required by law in any relevant jurisdiction, and the disclosure of the Clients name and e-mail address for the completion of the booking with the relevant Transfer Service Provider, AlpsDrivers.com will not disclose the Clients personal information to any third parties without the Clients consent.
7.1. Any variations to these terms and conditions, upon the Clients initiative, should be agreed to with AlpsDrivers.com in writing at the earliest possible convenience.
7.2 AlpsDrivers.com reserves the right to transfer, or subcontract, any or all rights and obligations under these terms and conditions at any time.
7.3 AlpsDrivers.com reserves the right to amend or alter the terms and conditions at any time, and make the new version available on the website. Following such amendments, or alternations, the website will be governed by the new version. The terms governing the purchase of Services, will be the terms and conditions in place at the time of purchase or booking. It is the responsibility of the Client, or potential Client, to familiarize themselves with the terms and conditions listed on the website on a regular basis.
7.4. Nothing can affect the consumer′s statutory rights.
7.5. Negotiation will be the initial course of action for the settlement of any disputes. Should the parties fail to agree during negotiation within 2 (two) calendar month, any disputes, differences or claims shall be settled by the courts of the Republic of Latvia.
7.6. Any dispute shall be settled in accordance with the law of the Republic of Latvia.
